theScore Hockey Top 10 Draft Contest
Official Contest Rules
NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT IMPROVE YOUR ODDS OF WINNING.
Eligibility: The “THESCORE HOCKEY TOP 10 DRAFT CONTEST” (the “Contest”) is open to legal residents of Canada (excluding the Province of Quebec), who are eighteen (18) years of age or older, except that you must be nineteen (19) years of age or older if you live in British Columbia, New Brunswick, Newfoundland, Northwest Territories, Nova Scotia, Nunavut, or Yukon. The Sponsors (as defined below), the respective subsidiaries and affiliates, and any other companies or agencies associated with this Contest, are collectively referred to herein as the “Contest Entities”. Employees of the Contest Entities and their immediate family members (defined as parents, parents-in-law, children, siblings and spouse (including common law), regardless of where they reside) are not eligible to enter the Contest or win Contest prizes. Any other persons with whom such employees are domiciled are also not eligible to enter the Contest or win Contest prizes. Void where prohibited.
The Draft: As used herein, the “Draft” means the 2023 NHL Draft, scheduled to begin on Wednesday, June 28, 2023.
Sponsors: The Contest is sponsored by Score Media and Gaming Inc. (“theScore”) and Dominion Lending Centres Inc. (each a “Sponsor” and collectively the “Sponsors”).
Agreement to Official Rules: By participating in this Contest, entrants agree to abide by the terms and conditions thereof as established by theScore. theScore reserves the right to qualify all submissions and to reject any submissions that do not meet the requirements for participation as established by theScore.
Entry Period: The Contest will accept Picks beginning on June 14, 2023 at 1:00 pm Eastern Time up to June 28, 2023 at 6:30 pm Eastern Time (the “Entry Period”). Picks received before or after the Entry Period are void. theScore’s computer server, on which the Contest is hosted, is the official time-keeping device for the Contest.
How to Enter: To enter this Contest, you will need to visit the contest page at https://contest.thescore.com/hockeytop10draft (“Contest Page”) from within theScore app or on a web browser. If you don’t already have theScore app, you can download it by going to thescore.com and clicking on “DOWNLOAD THE APP” or by visiting the App Store or Google Play store on your mobile device.
Once you are on the Contest Page, you can complete your entry. To complete your entry, you must make ten (10) selections by picking the top ten (10) picks of the Draft, including the name of the player and the draft position from 1 to 10. All selections (collectively “Picks”) must be submitted during the Entry Period. Picks will be deemed submitted when you click on “Submit” button within the Contest Page. Picks will be deemed complete if your submission consists of a selection for each of the top ten (10) picks of the Draft (“Complete Picks”). Complete Picks are locked and may not be updated or changed. Failure to submit Complete Picks makes you ineligible to win any prizes. The date and time of your submission, as recorded upon your click on the “Submit” button, shall be deemed to be your submission date and time for eligibility purposes. Limit one (1) set of Complete Picks per person. Anyone found to have submitted multiple entries and/or use multiple names, identities and/or more than one email address to enter the Contest will be disqualified from participating in the Contest or winning Contest prize.
In the event of a dispute over the ownership of an entry, the entry will be deemed to have been submitted by the person in whose name the email account was used in the Contest submission.
Any questions regarding the number of entries submitted or the owner of an entry shall be determined by theScore in its sole discretion, and theScore reserves the right, in its sole discretion, to disqualify any entries by persons determined to be tampering with or abusing any aspect of the Contest or any website pertaining to the Contest, or to be acting in an unsportsmanlike or disruptive manner. ANY ATTEMPT BY AN ENTRANT OR ANY OTHER PERSON TO DELIBERATELY DAMAGE ANY WEBSITE OR TO UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND, SHOULD SUCH AN ATTEMPT BE MADE, SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
Normal internet access and device usage charges imposed by your on-line service provider may apply. Sponsors assume no responsibility for computer system, hardware, software or program malfunctions or other errors, failures, delayed computer transactions or network connections that are human or technical in nature, or for damaged, lost, late, illegible or misdirected entries; technical, hardware, software, electronic or telephone failures of any kind; lost or unavailable network connections; fraudulent, incomplete, garbled or delayed computer transmissions whether caused by Sponsors, the users, or by any of the equipment or programming associated with or utilized in this Contest; or by any technical or human error that may occur in the processing of submissions or downloading, that may limit, delay or prevent an entrant’s ability to participate in the Contest. Sponsors are not liable for any loss, injury or damage caused, whether directly or indirectly, in whole or in part, from downloading data or otherwise participating in this Contest.
theScore reserves the right, in its sole discretion, to cancel this Contest should: (a) the Draft be rescheduled, delayed or cancelled; or (b) any virus, bugs or other causes beyond theScore’s control, unauthorized human intervention, malfunction, computer problems, phone line or network hardware or software malfunction, which, in the sole opinion of theScore, corrupt, compromise or materially affect the administration, fairness, security or proper play of the Contest or proper submission of Picks.
Selection of the Prize Winner: At the conclusion of the Draft, the number of correct Picks will be tallied for each entrant who has submitted Complete Picks. The entrant with the most number of correct Picks will be the winner. In the event of a tie between one or more entries, the tie will be broken by a random draw amongst the winning entrants.
The odds of winning depend on the number of eligible entries received.
Requirements and Notification of the Prize Winner: The Prize Winner will be notified via email on or about five (5) business days after the end of the Draft. If the Prize Winner does not acknowledge acceptance of his or her prize within ten (10) business days after being notified that he or she is the Prize Winner, the prize may be forfeited and another Prize Winner may be chosen using the same procedure specified above. Regardless of residency, the Prize Winner shall be required to correctly answer, without assistance of any kind, whether mechanical or otherwise, a time-limited mathematical skill-testing question to be administered during a pre-arranged telephone call or by e-mail at theScore’s sole discretion. If the Prize Winner does not correctly answer the skill-testing question, the prize will be forfeited and another Prize Winner will be chosen using the same procedure specified above. theScore may require the Prize Winner to provide a copy of a valid government issued photo identification as evidence of age and identity, and to sign and return an affidavit of eligibility and liability and publicity release, wherever lawful, as a precondition to award of the prize. If the Prize Winner fails to provide such identification and sign and return the requested documents to theScore in the time indicated by theScore, that Prize Winner may be disqualified, and the prize will thereafter be awarded to an alternate Prize Winner from the remaining valid entries using the procedure specified above. The prize shall be delivered to the Prize Winner at the mailing address provided by the Prize Winner.
The Prize: The Prize Winner will receive $5,000.00 CAD. Taxes, if any, are the sole responsibility of the Prize Winner.
Privacy: By submitting an entry, participants acknowledge and agree that any personal information that they provided will be maintained in accordance with theScore’s Privacy Policy, which can be found at thescore.com/pages/privacy. By participating in the Contest, you: (i) grant to the Sponsors the right to use your name, mailing address, telephone number, email address, user name, and game play information (including but not limited to Picks, scores, and standings) (“Personal Information”) for the purpose of administering the Contest, including but not limited to contacting and announcing the winner; (ii) grant to the Sponsors the right to use your Personal Information for publicity and promotional purposes relating to the Contest, in any and all media now known or hereafter devised, without further compensation unless prohibited by law; (iii) for any other business purposes as presented to you and accepted by you at the moment you provide your Personal Information to Sponsors; and (iv) acknowledge that the Sponsors may disclose your Personal Information to third-party agents and service providers of the Sponsors in connection with any of the activities listed in (i), (ii) and (iii) above. Sponsors will use the entrant’s Personal Information only for identified purposes, and protect the entrant’s Personal Information in a manner that is consistent with the Privacy Policy.
RELEASE: EACH ENTRANT AGREES TO RELEASE AND HOLD HARMLESS THE CONTEST ENTITIES AND THEIR RESPECTIVE SUCCESSORS AND ASSIGNS FROM AND AGAINST ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF ENTRANT’S PARTICIPATION IN THIS CONTEST. EACH ENTRANT AGREES THAT THE CONTEST ENTITIES AND THEIR RESPECTIVE SUCCESSORS AND ASSIGNS ARE NOT LIABLE FOR INJURIES, LOSSES OR DAMAGES OF ANY KIND ARISING FROM PARTICIPATION IN THIS CONTEST AND ACCEPTANCE, POSSESSION AND USE OF ANY PRIZE. THESCORE IS NOT RESPONSIBLE FOR ANY TYPOGRAPHICAL OR OTHER ERROR IN THE PRINTING OF THE OFFER OR ADMINISTRATION OF THE CONTEST OR IN THE ANNOUNCEMENT OF THE PRIZE. NO ENTRIES WILL BE RETURNED. ALL ENTRIES BECOME THE PROPERTY OF THE THESCORE.
DISPUTES: EACH ENTRANT AGREES THAT:
- ANY AND ALL DISPUTES, CLAIMS, AND CAUSES OF ACTION ARISING OUT OF OR IN CONNECTION WITH THIS CONTEST, OR ANY PRIZES AWARDED, SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORTING TO ANY FORM OF CLASS ACTION, PURSUANT TO ARBITRATION CONDUCTED UNDER THE COMMERCIAL ARBITRATION RULES OF THE AMERICAN ARBITRATION ASSOCIATION, TO TAKE PLACE IN TORONTO, ONTARIO, EXCEPT THAT YOU MAY ASSERT CLAIMS IN SMALL CLAIMS COURT IF YOUR CLAIMS QUALIFY;
- ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED, INCLUDING COSTS ASSOCIATED WITH ENTERING THIS CONTEST, BUT IN NO EVENT ATTORNEYS' FEES; AND
- UNDER NO CIRCUMSTANCES WILL ENTRANT BE PERMITTED TO OBTAIN AWARDS FOR, AND ENTRANT HEREBY WAIVES ALL RIGHTS TO CLAIM, PUNITIVE, INCIDENTAL, AND CONSEQUENTIAL DAMAGES, AND ANY OTHER DAMAGES, OTHER THAN FOR ACTUAL OUT-OF-POCKET EXPENSES, AND ANY AND ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED.
JURISDICTION: ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE OFFICIAL RULES, OR THE RIGHTS AND OBLIGATIONS OF ENTRANT AND SPONSORS IN CONNECTION WITH THE CONTEST, SHALL BE GOVERNED BY, AND CONSTRUED IN ACCORDANCE WITH THE LAW OF THE PROVINCE OF ONTARIO, PROVIDED THAT NOTWITHSTANDING THE FOREGOING, APPLICABLE LAWS IN CANADA MAY REQUIRE THAT THE LAWS OF THE CANADIAN JURISDICTION IN WHICH YOU RESIDE APPLY INSTEAD, IN WHICH CASE THE LAWS OF THAT JURISDICTION WILL APPLY.
